These Terms of Service (the “Terms”) are a binding agreement between you (“you”, the “User”, or, where you act on behalf of an organisation, the “Customer”) and PE “Firma Modul” (“OpenBP”, “we”, “us”, “our”) governing your access to and use of the OpenBP website at openbp.io (the “Website”) and the hosted OpenBP platform at panel.openbp.io (the “Platform”), together with all related applications, modules, and services (collectively, the “Service”).
Please read these Terms carefully. By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case “you” and “Customer” refer to that entity.

Supported by our EU affiliate Modul Soft sp. z o.o., Łąkowa 15 C, 82-200 Malbork, Poland (KRS: 0000404740, NIP: 5792248817, REGON: 221576016), acting as our service provider.
OpenBP is a modular business platform offering modules such as CRM, HRM, and ERP, provided as a hosted online service together with our informational Website.
OpenBP is proprietary software. We do, however, make certain components of OpenBP available as open source; only those specific components are open-sourced, and each is governed by the open-source licence specified with that component. These Terms govern the hosted Service that we operate; they do not govern any copy of those open-source components that you obtain and run yourself. Your self-hosted use of such open-source components is governed solely by their applicable open-source licences, and we provide them without warranty and without processing your data.
You must be at least 16 years old and have the legal capacity to enter into a contract. By using the Service you confirm that you meet these requirements and that the information you provide is accurate and complete. If you are a minor under the law applicable to you, you confirm that you have your legal guardian’s consent.
If you are a Consumer in the EU/EEA, you generally have the right to withdraw from a distance contract within 14 days of its conclusion, without giving any reason.

We may offer free, trial, or beta features. These are provided “as is”, may be changed or withdrawn at any time, and may be subject to additional terms communicated to you.

We may investigate suspected violations and take appropriate action, including suspension or termination of access.
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) 2016/679 and Polish data-protection law. How we collect, use, and protect personal data — and your rights and how to exercise them — is described in our Privacy Policy.
The Service may integrate with or link to third-party products and services. We do not control and are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.
If you use the Service otherwise than as a Consumer, you agree to indemnify and hold us harmless from claims, damages, liabilities, and reasonable costs (including legal fees) arising from your Customer Content, your use of the Service, or your breach of these Terms.
We may update these Terms from time to time. We will indicate the “Last updated” date and, for material changes, give notice through the Service or by email where required. If you are a Consumer and do not accept a material change, you may terminate before it takes effect. Continued use of the Service after changes take effect constitutes acceptance.
EU Consumers may use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr and may seek assistance from consumer-protection authorities (in Poland, UOKiK and the municipal or district consumer ombudsmen).
